The operator is also requesting that the court overturn the few elements of the decision – which held that iiNet should not be responsible for copyright violations conducted by its users – which did not go in iiNet’s favour.
AFACT has already lodged an appeal against the decision.
But iiNet managing director Michael Malone said he was confident of iiNet’s chances during the appeals process. “We go into this round anticipating that we will come out in an even stronger position than when we won last month,” he said.
